Abstract

Human rights are a fundamental concept in modern legal systems, emphasizing the protection of human dignity, individual freedom, and equality before the law. Although often regarded as a product of modern Western thought, many human rights principles are consistent with the values embodied in Islamic teachings. One of the prominent Muslim reformers who sought to integrate Islamic values with modernity was Muhammad Abduh (1849–1905). This study aims to analyze the concept of human rights in Muhammad Abduh’s thought and examine its relevance to modern constitutional law. The research employs a qualitative approach using a library research method through the analysis of Muhammad Abduh’s works and relevant scholarly literature. The findings indicate that Muhammad Abduh’s ideas concerning freedom of thought, human equality, and social justice are closely aligned with the principles of modern human rights. Furthermore, the concept of maqāṣid al-sharīʿah, which emphasizes the protection of religion, life, intellect, lineage, and property, provides a normative foundation for the recognition and protection of human rights in Islam. A comparative analysis with Western human rights theories, particularly those of John Locke and Jean-Jacques Rousseau, reveals common ground in terms of the protection of individual freedoms and the legitimacy of government based on the interests of society. In the Indonesian context, Muhammad Abduh’s ideas are also relevant to the principles enshrined in the 1945 Constitution of the Republic of Indonesia, especially regarding the guarantee and protection of human rights. Therefore, Muhammad Abduh’s thought can serve as a conceptual foundation for developing a human rights discourse that harmonizes Islamic values with the principles of modern constitutional governance.
