Abstract

Employee Additional Income Policy (Tambahan Penghasilan Pegawai/TPP) constitutes a strategic instrument within bureaucratic reform aimed at enhancing the discipline, performance, and welfare of civil servants (Aparatur Sipil Negara/ASN), yet its disbursement is inherently linked to a deduction mechanism imposed on personnel who fail to meet attendance or performance standards. Indragiri Hilir Regency has enacted Regent Regulation Number 4 of 2025 as the juridical basis for TPP deductions; however, its implementation remains burdened by concerns over performance-assessment transparency, sanction accuracy, and administrative-technical obstacles. Prior studies on TPP have predominantly examined work motivation, e-performance systems, and internal supervision, without specifically addressing the juridical validity of the deduction norms themselves, thereby constituting the research gap this article seeks to address. This study aims to analyze the legal validity of TPP deduction regulations under the Indragiri Hilir Regent Regulation and to examine their consistency with general principles of good governance (algemene beginselen van behoorlijk bestuur). The research employs a normative legal method through a statute approach and a conceptual approach, drawing upon primary, secondary, and tertiary legal materials analyzed qualitatively through a prescriptive method. The findings indicate that the Regent's authority is attributive and hierarchically valid, and that the TPP deduction norms have accommodated the principles of legal certainty, prudence, proportionality, and transparency. Nevertheless, the study identifies vertical disharmony arising from outdated legal references that have not yet incorporated Law Number 20 of 2023, a normative vacuum concerning government employees under work agreements (Pegawai Pemerintah dengan Perjanjian Kerja/PPPK), and horizontal disharmony in the forum for resolving administrative disputes. These findings imply the necessity of normative restructuring to ensure that legal certainty and the protection of ASN's administrative rights are realized more comprehensively and equitably
